JUDGMENT

[1]The statutory time limit for issue of the proceedings expired within the period of ACAS Early Conciliation which took place between the 16 September and 16 October 2020 (Day B). By virtue of section 207B(3) & (4) Employment Rights Act 1996 the time limit ended one month after Day B, namely the 16 November 2020.

[2]The claim having been presented on the 17 November 2020 was received out of time.

[3]The tribunal being satisfied that it was reasonably practicable to have presented the claim in time, it has no jurisdiction to determine it and it is dismissed.
