JUDGMENT
[1]The respondent breached the claimant’s contract of employment in respect of overtime pay, and the claim for overtime succeeds in part.[2]The claimant was not constructively dismissed by the respondent. His complaint of automatic unfair dismissal fails.[3]The respondent is ordered to pay the claimant the sum of £1,456.13 in respect of unpaid overtime. This is the gross sum; payment of the net sum may be made provided that the correct tax and national insurance payments due on the sum are paid to HMRC.
