JUDGMENT
[1]The respondent has made unauthorised deductions from the claimant’s wages and/or is in breach of contract and is ordered to pay the claimant the gross sum of £98.93 (subject to Tax and National Insurance deductions).[2]The respondent has failed to pay the claimant’s holiday entitlement and is ordered to pay the claimant the gross sum of £643.33 (subject to Tax and National Insurance deductions)REASONS
[1]The claimant told me and I accept that there was no agreement for breaks to be automatically applied and not paid. I find that the claimant was not paid for 6.5 hours and is entitled to the gross sum of 98.93.[2]In a letter dated 13 September 2020 the respondent accepts that the claimant was owed £643.33 for holiday pay. Case Number: 3313558/2022[3]Whilst the claimant claims £226.85 as he was never given a pay slip showing this deduction, he accepts that it was a deduction of Tax and National Insurance relating to a gross payment of £684.90 he had been paid. Accordingly, I find that he was not owed this sum.
