The claim is struck out.

REASONS

[1]By a letter dated 19 April 2023 the Tribunal gave the claimant an opportunity to contact the Tribunal by 26 April 2023 to make representations or to request a hearing, as to why the claim should not be struck out because  the claimant had not complied with the Order of the Tribunal dated 8 February 2023.  it has not been actively pursued.  of the reasons stated in the Respondent’s applications dated 19 and 23 March 2023.[2]The Claimant’s email of 23 March 2023 at 16:50 had already been taken into account by EJ R Lewis before the warning letter was issued. That item had not been sent to the Respondent (in breach of the rules) and EJ Lewis commented on it in a separate letter also dated 19 April 2023.[3]Since the warning, the Respondent's representative has sent further communications (copied to the Claimant) about alleged failure to comply with the orders. Those were 20 April and 27 April 2023.[4]The claimant has failed to make representations in writing and has failed to ask for a hearing. The claim is therefore struck out. The hearing fixed for 9 and 10 May 2023 will not take place.
