JUDGMENT

[1]The complaints of unfair dismissal, redundancy pay, failure to inform or consult, notice pay and unpaid wages as set out in the claim form are declared to be well-founded.[2]Any remedy to which the claimant is entitled will be determined at a Hearing for which two hours have been allocated at 2pm on Monday 20 January 2020 at Watford Employment Tribunal, 51 Clarendon Road, Watford, WD17 1HP.[3]The claimant must prepare a schedule of the sums claimed and a bundle of documents relating to any remedy claimed. Warren MacKenzie Electrical Services Limited (in liquidation) v Heard at: Watford On: 20 January 2020 Before: Employment Judge Heal Appearances For the Claimant: in person For the Respondent: not present or represented REMEDIES JUDGMENT Judgment on liability having been given in favour of the claimant and sent to the parties on 20 December 2019, the tribunal awards the following remedies:[1]A redundancy payment has already been made to the claimant by the Insolvency Service, so no further award is made.[2]An payment has already been made to the claimant by the Insolvency Service for his arrears of pay in the sum of £657.92 gross, (£526.32 net) and so no further award is made for unauthorised deductions from wages.[3]The respondent shall pay to the claimant the sum of £4,438.38 net (9 weeks wages), compensation for breach of contract in failing to give statutory notice.[4]The respondent shall pay to the claimant the sum of £9098.99 (13 weeks’ gross pay) for breaches of regulation 15 of the Transfer of Undertakings (Protection of Employment) Regulations 2006.[5]The respondent shall pay to the claimant the sum of £2,958.92 (6 weeks’ loss of earnings) as a compensatory award for unfair dismissal.[6]No further award is made for the basic award.
