JUDGMENT
[1]The Respondent’s name is amended to “Finance Giant Ltd (trading as Car Finance Giant)”.[2]The Respondent made an unlawful deduction from the Claimant's wages and is ordered to pay to the Claimant the net sum of £5248.98, being the amount unlawfully deducted (£ 5189.33) plus £ 59.65 in banking charges incurred by the Claimant and attributable to the deductions. The Respondent will be responsible for the payment of any tax and/or national insurance contributions due on the payment.[3]The Respondent's counter-claim is dismissed. The Tribunal had no jurisdiction to hear the counter-claim since the original claim was not made under the Employment Tribunals Extension of Jurisdiction (England and Wales) Order 1994/1623.
