JUDGMENT
[1]The following complaints are struck out.a. The direct race discrimination complaints identified at paragraphs 3.3.4 and 3.3.5 of the list of issues.b. The harassment complaints (whether related to race or disability) identified at paragraphs 4.1.3 and 4.1.4 of the list of issues.c. The entire victimisation complaint (since the only detriments are those in paragraphs 5.3.1 to 5.3.3 of the list of issues and each of those allegations are struck out)REASONS
[1]The claimant was ordered to pay seven deposit of £50 each following a preliminary hearing held on 7 August 2023. The Order was sent to the claimant on 9 August 2023.[2]The claimant has failed to pay any of these deposits.[3]The above-mentioned complaints are therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013.[4]The hearing remains due to take place as scheduled to deal with the remaining claims. If either party believes that the hearing should be shortened, they should write to the Tribunal and the other party as soon as possible.
