JUDGMENT

For the reasons given in the oral judgment at the hearing:[1]The following complaints of unfavourable treatment because of something arising in consequence of disability are well-founded and succeed:a. Promoting another team member into the Claimant’s SAP office job role on a permanent basis with effect on or about 8 August 2020.b. In March 2020 being demoted from her SAP office job role to a picking role,c. On 3 March 2021, the respondent’s decision not to move the claimant back to her office role. The Claimant says that she was informed that “ there was no room in the office” in Helen Barnes’ grievance response letter on that date.[2]The remaining complaint of unfavourable treatment because of something arising in consequence of disability is not well-founded and is dismissed.[3]The Claimant’s complaints of Direct Discrimination are not well founded and are dismissed.[4]The Claimant’s complaints of Harassment related to disability are not well founded Case Number: 3313123/2021 and are dismissed.[5]The Respondent must pay the Claimant £9,426.66 in total within 28 days. This sum consists of £7000 in injury to feelings and £2,426.66 in interest. _
