EMPLOYMENT TRIBUNALS
Case No 3312962/2020
Mr M BoscoeClaimantNationwide Crash Repair Centre Ltd (in administration)Respondent
Employment Judge DunlopDate 3 May 2022

JUDGMENT

This was a determination on papers with no attendance by any party.[1]The Tribunal makes a protective award in favour of the claimant and orders the respondent to pay remuneration for a protected period of 90 days beginning on 4 September 2020.[2]There is no order requiring any party to pay or reimburse another party’s costs or fees. Each party shall bear their own costs and fees.[3]The Employment Protection (Recoupment of Benefits) Regulations 1996 apply to this award.

REASONS

[1]The claimant was employed by the respondent ay its Warrington site. On 21 September 2021 I gave a judgment making a Protective Award in respect of a number of claimants who had been employed at that site.[2]At that time, Mr Boscoe’s claim was not before me, as it was awaiting transfer from another region. I am now satisfied that Mr Boscoe’s circumstances are the same as the claimants in the other claims (lead case number 2415501/2020), and I make the protective award in this case for the same reasons.[3]This matter has been determined on the papers in view of information sent in by the parties, and in line with my Judgments issued in other cases. If any party considers that Mr Boscoe is not entitled to a protective award, then they are reminded that they may apply for a reconsideration of the Judgment. Further information is contained in the leaflet provided alongside the Judgment. Case No:3312962/2020
