JUDGMENT
[1]All claims against the second respondent are dismissed upon withdrawal.[2]Claimant was not automatically unfairly dismissed by the first respondent.[3]The first respondent did not make unauthorised deductions from the claimant’s wages (re. holiday entitlement and commission) contrary to section 13 of the Employment Rights Act 1996.[4]The first respondent breached the claimant’s contract of employment by failing to pay a week’s wages in lieu of notice. Consequently, the first respondent must pay to the claimant the sum of £1692.31 which is equivalent to a week’s wages.[5]The claim of victimisation against the first respondent is dismissed upon withdrawal by the claimant.[6]The claim of harassment related to race against the first respondent is dismissed upon withdrawal.
