JUDGMENT

[1]The Claimant has agreed to withdraw the claims against the first Respondent and have them dismissed as per agreed in the Settlement Agreement between the parties.[2]The claim against the second Respondent continues.[3]The claims against the third Respondent have been settled and it has been agreed the title of the third Respondent is to be recited as LT Pub Support Services Limited, removing the wording HO.[1]As the claim against the second Respondent, Milton Pubs and Taverns Limited is proceeding, albeit they are in liquidation, currently the claim has been served upon the Liquidator and a direction that a Response be entered within 28 days from 22 October 2019.[2]In the event no Response is entered, it will be open to the Claimant to request Judgment in Default. Case Number: 3312700/2019[3]A Telephone Conference has been listed for 10:00am on 9 December 2019 for further directions in the event the matter is to proceed to a Full Hearing.[1]The Claimants’ claims that the Second Respondent failed to comply with the obligation to notify employee liability information under regulation 11 of the Transfer of Undertakings (Protection of Employment) Regulations 2006 (“TUPE”) are well founded.[2]The Second Respondent shall pay the First Claimant the sum of £229,000.00 (£500 for each of the 458 employees who transferred to the First Claimant) under regulation 12 of TUPE.[3]The Second Respondent shall pay the Second Claimant the sum of £240,500 (£500 for each of the 481 employees who transferred to the Second Claimant) under regulation 12 of TUPE.
