The complaint that the claimant was unfairly dismissed is struck out.REASONS
[2]Section 108 of the Employment Rights Act 1996 requires a claimant to have not less than two years service to make an unfair dismissal complaint.[3]The claimant was employed by the third respondent for less than two years.[4]Therefore the claimant is not entitled to bring such a complaint.[5]Accordingly, the complaint of unfair dismissal is struck out. The claimant’s other complaints are not affected by this judgment.[1]The claimant initially brought proceedings against all respondents. However, following the preliminary hearing on 25 April 2023, it transpired that there were no factual allegations made against the second respondent.[2]As such, there are no complaints/claims made against the second respondent.[3]The claimant’s remaining claims remain listed for hearing on 13, 14, 15, 20 and 21 November 2023. 6.3 Strike Out Judgment – claim – part - rule 37 Case No:3312680/2022
