Employment Tribunals Rules of Procedure 2013 – Rule 21 The respondent having failed to present a response to the claim, judgment for the claimant is issued under rule 21 as follows:[1]The claimant was dismissed by reason of redundancy and is entitled to a statutory redundancy payment of £5,649. The claim was presented within the time limit set out in section 164 of the Employment Rights Act 1996.[2]The tribunal does not have jurisdiction to consider the claimant’s claim for a contractual lump sum payment, as the claim was presented after the expiry of the time limit of three months for claims of breach of contract set out in the Employment Tribunals Extension of Jurisdiction Order 1994.
