Mr G Woods and others v Booker Ltd: 3312508/2022 and others
JUDGMENT
The claims are struck out.REASONS
[1]By a Case Management Order (at paragraph 26 (iv)) sent to the parties on 16 February 2023 the Tribunal made clear what would happen next in the management of these claims in the event that the claimants (or any of them) failed to write to the Tribunal by 17 March 2023 addressing issues relating to time limits and prospects of success of these claims. The wording of the relevant Order is as follows: “Claimants who do not write to the Tribunal in response to the orders in Part Two of this document by 17 March 2023: These claimants’ claims will be struck out by the Judge without a hearing after the 17 March 2023 deadline has passed. That is because the onus is on the claimants to show why there is some reasonable prospect of them being able to show their claims were brought in time or to ask for that to be considered at a hearing.”[2]The claimants on the attached schedule have failed to write to the Tribunal as instructed. The claims are therefore struck out.[3]The hearing fixed for 15 June 2023 will not take place.
