Mr L Westall and Mrs L Westall v R Toogood: 3312432/2020 and 3312433/2020
JUDGMENT
Rule 21 of Schedule 1 to the Employment Tribunals (Constitution and Rules of Procedure) Regulations 2013 Response[1]The Respondent failed to present a response to the claim and judgment is entered in favour of the Claimants as follows. Unauthorised Deduction from Wages[2]The First Claimant (Mr L Westall) is owed unpaid wages and is awarded £2,000 in compensation. The Respondent is ordered to pay this sum to the First Claimant.[3]The Second Claimant (Mrs L Westall) is owed unpaid wages and is awarded £2,000 in compensation. The Respondent is ordered to pay this sum to the Second Claimant.[4]The Claimants’ claim for additional compensation or for repayment of a loan are dismissed. To requirement payment of the loan as well as payment of the unpaid wages would be to give compensation twice for the same matter, and the other compensation claimed is not something that would fall within the jurisdiction of the tribunal in a claim of unlawful deductions from wages.
