JUDGMENT

[1]The Claimant’s claim of constructive dismissal succeeds. The Respondent must pay the Claimant:1.1 Basic Award of £14,798;1.2 Compensatory Award of £1,616.84.[2]The Claimant’s claim of wrongful dismissal succeeds. The Claimant was not given the 12 weeks’ notice that he was entitled to as his minimum statutory notice under the Employment Rights Act 1996. The Respondent must pay the Claimant 12 weeks’ wages (less mitigation) in the sum of £4,223.56.[3]The Claimant’s claim of unlawful deduction of wages succeeds and the Respondent must pay the Claimant the sum of £1,176.04 for wages unlawfully deducted in June and July 2023.[4]The Respondent is entitled to make appropriate deductions for income tax and national insurance to the payments above, save for the Basic Award which should be paid gross.
