JUDGMENT

[1]The employment of the Claimant was transferred from the Second Respondent to the First Respondent on 2 August 2020 by virtue of Regulation 4 of the Transfer of Undertakings (Protection of Employment) Regulations 2006.[2]The First Respondent made an unauthorised deduction from the Claimant’s wages and is ordered to pay the sum of £3,747 being the gross sum payable.[3]The Claimant was dismissed in breach of contract on 9 January 2021 in respect of notice pay and the First Respondent is ordered to pay the Claimant her statutory notice pay which is £174 gross.[4]The First Respondent failed to pay the claimant accrued holiday pay for the period from 2 August 2020 to 9 January 2021 and is ordered to pay the sum of £452.26 gross.[5]The First Respondent is accordingly ordered to pay the sum of £4373.26 in total.[6]The Claimant’s claim for discrimination on the grounds of age does not succeed and is dismissed.
