JUDGMENT
[1]The name of the respondent is changed from Milton Keynes Family Mediation MediationMK to Milton Keynes Family Mediation Limited.[2]The claimant was dismissed by reason of redundancy and her claim for a redundancy payment is well founded. The respondent shall pay the claimant a redundancy payment of £1273.88.[3]The complaint of breach of contract in relation to notice pay is well founded. The respondent shall pay the claimant £849.25 as damages for breach of contract. This figure has been calculated using gross pay to reflect the likelihood that the claimant will have to pay tax on it as Post Employment Notice Pay.[4]The complaint of unauthorised deductions from wages is well-founded. The respondent made an unauthorised deduction from the claimant's wages in the period 1 July 2023 to 1 September 2023. The respondent shall pay the claimant £1472, which is the gross sum deducted. The claimant is responsible for the payment of any tax or National Insurance.[5]The complaint for holiday pay is well founded. The respondent failed to pay the claimant for holidays accrued but not taken on the date the claimant’s employment ended. The respondent shall pay the claimant £305.73 gross. The claimant is responsible for the payment of any tax or National Insurance. 10.2 Judgment - rule 61 February Case No: 3311867/2023[6]The complaint of unfair (redundancy) dismissal is well-founded. The claimant was unfairly dismissed. The respondent shall pay the claimant the following sums:(a) A basic award is £0 because a redundancy payment has been awarded by the tribunal in respect of the same dismissal.(b) A compensatory award of £1019.10 Note that these are the actual sums payable to the claimant after any deductions (including notice pay, which has been deducted from the compensatory award) or uplifts have been applied.[7]The Employment Protection (Recoupment of Benefits) Regulations 1996 do not apply as the Claimant did not receive any benefits during the relevant period.[8]The total award payable to the claimant is £4,919.96.
