JUDGMENT
[1]The complaint (case number 3311847/2023) of unauthorised deduction from wages is well-founded. The Respondent was obliged to pay £2877.66 gross, or £2130.08 net (after PAYE, pension and Student loan) in September 2023 and failed to pay anything. The Respondent is ordered to pay the gross sum of £2877.66 to the Claimant. The judgment will be satisfied by paying the net sum of £2130.08 if, but only if, the Respondent properly accounts to the appropriate third parties for the respective sums PAYE, pension and Student loan as identified in the payslip. The payment must be made without any other deduction or set off whatsoever.[2]One of the Respondent’s directors sent an email to the Tribunal at 18/11/2024 09:57. On the assumption that the director was properly authorised by the company then that email brought the employer’s contract claim (case number 3311480/2024) to an end with immediate effect and I now dismiss that employer’s contract claim (case number 3311480/2024) on withdrawal.[3]In the alternative, if that email did not amount to a withdrawal of the claim, Case No: 3311847/2023 & 3311480/2024 then I dismiss the employer’s contract claim (case number 3311480/2024) under Rule 47.
