JUDGMENT
[1]The claim of direct disability discrimination is not well founded and is dismissed.[2]The respondent was in breach of the duty to make reasonable adjustments by failing to direct the claimant to take breaks/ time away from typing duties to alleviate the pain in his elbow between 24 May 2022 and 9 June 2022.[3]By a majority (Employment Judge George and Mrs J Wood, the employer’s side representative), the respondent shall pay to the claimant the sum of £1,662.03 in compensation for a breach of duty to make reasonable adjustments. That is calculated as follows: Compensation for injury to feelings 1,500.00 Interest @ 8% from 1 June 20221 162.03 and 4 October 2023 491 days @ £0.33 per day Total £1,662.03 1 The mid-point between 24 May 2022 and 9 June 2022.
