JUDGMENT
[1]The claimant was not an employee or worker of the respondent within the meanings in section 230(1), (2) and (3) (a) and (b) of the Employment Rights Act 1996.[2]The tribunal has no jurisdiction to hear the claimant’s claims of unauthorised deduction from wages or breach of contract as the claimant is neither an employee or worker of the respondent. The claims are therefore dismissed.[3]The sum of £500.00 paid by the claimant under a deposit order made on 29 July 2022 is forfeit and shall be paid to the respondent in accordance with rule 39(5) of the Employment Tribunals Rules of Procedure 2013.
