JUDGMENT

[1]The claimant’s claim of race discrimination is struck out for lack of jurisdiction. It was presented out of time and it is not just and equitable to extend time pursuant to s123(1)(b) of the Equality Act 2010.[2]The claimant’s claim for unfair dismissal is struck out for lack of jurisdiction. The claimant lacks sufficient qualifying service to bring a claim of unfair dismissal pursuant to s108(1) Employment Rights Act 1999 and no automatically unfair reason is asserted.[3]The claimant’s claim for whistleblowing is dismissed upon withdrawal.
