The claim is struck out.REASONS
[1]By a letter dated 20 March 2024 the Tribunal gave the claimant an opportunity to contact the Tribunal by 11am on 22 March 2024 to respond to the Respondent’s 29 November 2023 application which sought strike out, citing Rules 37(1)(c) and 37(1)(d).[2]That email, which was not the Respondent’s first strike out request, was copied to the Claimant, but there was no response from the Claimant. The Respondent chased for a strike out decision on 14 February, 29 February and 14 March 2024, also copying the Claimant, each time. There was no response from the Claimant to any of those either.[3]The claimant has failed to make representations in writing as to why the claim should not be struck out, and has failed to respond at all. The claim is therefore struck out.[4]The hearing fixed for Monday 25 March 2024 will not take place.
