The claim is struck out.

REASONS

[1]By an order sent to the parties on 9 September 2024 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because they had not been actively pursued.[2]On 23 September 2024 (within the time allowed for the hearing) the claimant wrote saying she was unwell, had been unable to contact her representative and “I’m liaising with the discrimination team at legal aid and I feel confidence to push forward with them”. It is now 2 December 2024 and no further correspondence has been received nor, so far as I can tell, has the claimant taken any further steps. The intended final hearing is now only a month away.[3]In those circumstances I have struck out the claimant’s claim on the basis that it has not been actively pursued.
