JUDGMENT
[1]The claimant’s claim is for breach of contract in respect of changes to the respondent’s pension scheme. He seeks compensation for losses arising from those changes. The claim cannot be read as a complaint of unauthorised deduction from wages under the Employment Rights Acts 1994.[2]The tribunal has no jurisdiction to hear the claimant’s claim for breach of contract. This is because the claim form was presented before the period of three months beginning with the effective date of termination of the contract giving rise to the claim. It was therefore presented outside the period required by article 7 of the Employment Tribunals Extension of Jurisdiction (England and Wales) Order 1994.[3]For this reason, the claimant’s claim is dismissed.
