The claim is struck out.

REASONS

[1]By a Case management Order, sent to the parties on 1st July 2025, the Tribunal gave the Claimant an opportunity to make representations or to make request a hearing at which to do so, as to why the claim should not be struck out. It appeared a fair hearing was no longer possible because: - The Claimant had not complied with the Order of the Tribunal dated 10th March 2025, - It has not been actively pursued,[2]The Claimant has failed to make representations in writing why this should not be done or to request a hearing. A fair hearing is not possible. The Claim is therefore struck out.[3]The Claimant’s claim having been struck out, the Respondent’s claim for breach of contract is dismissed following withdrawal by the Respondent. Approved by:
