The claim is struck out.REASONS
[1]In this matter, the Claimant has not supplied an early conciliation certificate number, and has not supplied proof that the exemption relied upon (the fact that, according to the Claimant, the Respondent had contacted ACAS) actually applied. I proceed on the assumption, without deciding, that the rules did not require the claim form to have been rejected.[2]The names of the Claimant and the Respondent as stated above are taken from Box 1 and Box 2 respectively of the claim form received by the Tribunal on 12 July 2022. In any event, correspondence has been sent to each of those individuals at the addresses stated in the claim form.[3]By a letter dated 28 January 2023 the Tribunal gave the claimant until 20 February 2023 to make representations or to request a hearing, as to why the claim should not be struck out because it has not been actively pursued.[4]The claimant has failed to make representations in writing and has failed to ask for a hearing. The claim is therefore struck out.
