JUDGMENT

[1]The Swan M E Limited is substituted as the Respondent since it (and not Mr Young) was the Claimant’s employer.[2]The complaint of unauthorised deductions from pay contrary to Part II of the Employment Rights Act 1996 is well-founded. The Respondent made unauthorised deductions from the Claimant’s pay in respect of the period 20 May 2022 to 6 June 2022. The Respondent is ordered to pay the Claimant the gross sum of £2692.34 deducted from pay.[3]The Respondent’s counterclaim for breach of contract is struck out since the Claimant does not rely on a breach of contract and correspondingly there is no jurisdiction in respect of the counterclaim under the Employment Tribunals Extension of Jurisdiction (England and Wales) Order 1994.
