JUDGMENT

[1]The claim was presented in the Watford Employment Tribunal on 13 September 2024. The Respondent failed to present a valid response on time. The Employment Judge has decided that a determination can properly be made of the claim, or part of it, in accordance with rule 22 of the Rules of Procedure. Today’s hearing was converted to a final hearing under Rule 48.[2]I find that Alfateq Limited was the employer of Mr Gibbs and they are substituted as Respondent under Rule 35 in place of Mr Edmond Kirkham.[3]The Respondent has made unauthorised deductions from Mr Gibbs’ wages and must pay Mr Gibbs £8,000 gross.[4]Mr Gibbs was dismissed in breach of contract in respect of notice and the Respondent must pay damages to Mr Gibbs of £923.07.[5]The Respondent has failed to pay Mr Gibbs’ holiday entitlement and must pay Mr Gibbs £1571.42[6]Mr Gibbs’ complaint of whistleblowing detriment is dismissed upon withdrawal.[7]The Respondent must pay Mr Gibbs £10,494.49 in total.
