JUDGMENT

The complaints of unfair dismissal and redundancy payment are struck out.

REASONS

[1]By letters dated 4 October 2023 the Tribunal gave the claimant an opportunity to make representations as to why the complaints of unfair dismissal and redundancy payment should not be struck out because at the date of dismissal the claimant had been continuously employed for less than two years.[2]The claimant has failed to make any sufficient representations, why these complaints should not be struck out. Accordingly, the complaints are struck out pursuant to r37(1)(a) Employment Tribunal Rules 2013.[3]The claimant’s remaining claims of discrimination on the grounds of race and disability; wrongful dismissal and other payments remain listed. _____________________________ Employment Judge Bansal 28 February 2024[1]The complaint of breach of contract or “wrongful dismissal” (being failure to give notice and/or failure to pay correct amount in lieu of notice) is struck out.[2]The only remaining complaints are those itemised in section 1 of list of issues produced by EJ Bloch KC and sent to parties on 27 August 2024: namely 7 allegations (items 1.2.1 to 1.2.7) each of which is alleged to be direct discrimination because of race and/or direct discrimination because of age. None of these remaining complaints are struck out.
