JUDGMENT

[1]By reference to list of issues produced by EJ Skehan (following hearing dated 19 July 2024, and sent to parties on 18 September 2024) the following claims are struck out. 1.1. All complaints alleging disability discrimination (section 4 of list of issues). 1.2. The complaints of race discrimination itemised at paragraphs 3.2.2 and 3.2.3 of list of issues.[2]As a result of the decisions in paragraph 1 above, the only remaining complaint is that the act/omission alleged in paragraph 3.2.1 of list of issues amounted to race discrimination. This remaining complaint is not struck out by this judgment, but a decision may be necessary in due course about whether to strike it out under Rule 37. Separate orders have been made.

REASONS

[1]The claimant was ordered to pay two deposits of £100 each following a preliminary hearing held on 19 July 2024.[2]The Order was sent to the claimant on 18 September 2024.[3]The claimant has failed to pay either deposit.[4]The complaints mentioned in paragraph 1 of the judgment above are therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013.[5]The hearing fixed for 10 to 12 March 2025 remains scheduled at present.
