JUDGMENT
[1]The claimant’s application to amend the claim to include a claim for constructive dismissal and a claim under the Equality Act for the protected characteristic of disability is refused.[2]Even if the application to amend was granted to include a claim under the Equality Act for the protected characteristic of disability it would nevertheless be dismissed as in any event it has no reasonable prospect of success.[3]The claimant confirming in the course of today’s hearing there is no claim for holiday pay or unlawful deduction of wages outstanding.
