JUDGMENT
[1]The claimant having less than 2 years’ service with the respondent and having failed to respond to a strike out warning by 31 August 2023, the complaint of unfair dismissal is struck out under Rule 37 Employment Tribunal Rules of Procedure 2013 as it has no reasonable prospect of success.[2]The name of the respondent is amended to Silva Homes Limited.[3]The response, as contained in the draft response sent on 16 May 2024, is now accepted out of time under Rule 20 Employment Tribunal Rules of Procedure 2013.[4]An unless order has been made with respect to the complaint of disability discrimination which will proceed when and if the claimant responds.
