C Smith v Direct Independent Care Ltd: 3307099/2022
JUDGMENT
The claim is struck out.REASONS
[1]On the 22 February 2023 this case was listed for a telephone hearing at 10 am. Despite attempts by the Tribunal to telephone the claimant there was no answer and the hearing did not take place.[2]By a letter dated 7 March 2023 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because it has not been actively pursued.[3]On 7 March 2023 at 19:43 the claimant sent an email to the respondent as follows: “I apologize for myself not attending the tribunal hearing case previously held on 22/02/2023 however I am having real difficulty in dealing with all the rouge and corruptive data breachings(sic) by [the claimant then lists a number of parties involved in family court case] however my family court case has been corrupted due to this all still on going on throughout the last eight month now really do not believe its right that they get to try and corrupt another legal case proceedings now and will be more than happy to attend another employment tribunal case hearing after these family court proceedings have been closed and all the privacy date breachings (sic) have been completely stopped too.” Case No: 3307099/2022[4]The claimant’s representations show that the claimant is not currently actively pursuing this case and has no intention of doing so at this time. The claim is therefore struck out.
