JUDGMENT

[1]The claimant’s claim for unlawful deductions from wages and breach of contract against the respondent are well founded and succeed.[2]The claims for unfair dismissal, disability discrimination and race discrimination are dismissed upon withdrawal by the claimant.[3]The claims for emotional distress and for financial harm are not successful as the tribunal does not have jurisdiction to make such awards in this case. REMEDY[1]The claimant is awarded from the respondent £3322.94 net for unpaid February pay; £692.20 for unpaid March pay, £329.75 for February expenses and £81.40 for March expenses. The respondent is ordered to make payment of these sums forthwith and shall also be wholly responsible for appropriate deductions of tax and NI at source and payment to HMRC.[2]The Recoupment Regulations do not apply.
