JUDGMENT

[1]The tribunal has jurisdiction to hear the claims for unfair dismissal and disability discrimination.[2]The reason for one dismissal related to the claimant’s conduct and that dismissal was not unfair.[3]The reason for another dismissal related to the claimant’s capability and that dismissal was not unfair.[4]The claimant was disabled at the material time but there was no direct discrimination, discrimination arising from the consequences of the disability or failure to make reasonable adjustments.[5]The claims for unfair dismissal and disability discrimination fail and are dismissed.[6]The claimant’s conduct in pursuing this litigation after offers to settle were made was, in the circumstances, unreasonable.[7]Having taken into account the claimant’s ability to pay, no order for costs is made. 10.2 Judgment - rule 61 Case No: 3306955/18
