JUDGMENT
[1]The claimant’s claim of unauthorised deduction from wages was presented outside the primary time limit of 3 months and the tribunal is not satisfied that it was not reasonably practicable for the claim to be presented before the end of that period of 3 months. Consequently, the tribunal does not have jurisdiction to hear the claim and it is dismissed.[2]The claimant’s complaints of age discrimination and race discrimination were presented outside the primary time period of 3 months and the tribunal finds that it is not just and equitable to extend time. [1]Following hearings on 2 November 2022 and 20 February 2023 and subsequent orders, on 6 March 2023, the Respondent re-applied for strikeout of the claim by way of an email of 6 March 2023.[2]The Claimant states that a document received from the Claimant on 4 March 2023 does not adequately explain the Claimant’s continued and ongoing failure to comply with directions for case preparation for the final hearing, which is due to take on place on 12 and 13 April 2023.[3]In light of all of the circumstances, and in accordance with Rule 37 of The Employment Tribunals Rules of Procedure 2013, the Tribunal strikes outthe claim.
[4]The hearing fixed for 11 and 12 April 2023 will not take place.
