Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claim was issued in the Watford Employment Tribunals on 25 July 2022. The respondent has failed to present a valid response on time. The Employment Judge has decided that a determination can properly be made of the claim, or part of it, in accordance with rule 21 of the Rules of Procedure.[2]The claimant was dismissed without notice in breach of contract and the respondent is ordered to pay the claimant damages, in lieu of 1 weeks’ notice, in the sum of £700.00.[3]The respondent failed to provide a written statement of terms and conditions to claimant as required by Section 38 of the Employment Act 2002. [1]By a letter dated 16 February 2023 the Tribunal gave the claimant an opportunity to make representations or to request a hearing, as to why the complaint of unfair dismissal should not be struck out because the claimant had not complied with the Order of the Tribunal dated 2 March 2023 direction which was not complied with.[2]The claimant has failed to make representations in writing, or has failed to make any sufficient representations, why this should not be done or to request a hearing. The complaint of unfair dismissal is therefore struck out.
