JUDGMENT

(1) The Claimants’ application to join Mr Christopher Wakeling as a party to the claim, made without notice at the start of this hearing on 28 October 2021, is refused.(2) The Claimants’ claims for a protective award pursuant to section 189 of the Trade Union and Labour Relations (Consolidation) Act 1992 are well- founded. It is declared that the Claimants are all entitled to a protective award.(3) The protective award is for a period of six weeks for each Claimant.(4) On that basis, the Respondent is ordered to pay the following awards to the following Claimants:a. To Ms Anna Olszanska - £3,415.38;b. To Ms M. Klimanskyte - £3,415.38;c. To Ms J. Levinskaite - £4,038.48;d. To Ms M. Sienkiewicz - £3,672.00e. To Mr M. Simao: £3,360.00.(5) The remaining Claimants who are represented by Unionline, solicitors, must provide to the Administrator of the Respondent and to the Tribunal on or before 11 November 2021 details of the amount of their protected award, calculated, in accordance with this judgment, on the basis of six weeks’ pay. Those calculations should be sent to the Tribunal marked “for the attention of Employment Judge McNeill QC” so that judgment for the relevant amounts may be prepared and promulgated as appropriate.(6) The Claimants Mr Rafalia, Mr Roqi and Mr Swieconek must similarly provide details of their calculations of six weeks’ pay and must send those calculations to the Administrator of the Respondent and to the Tribunal, similarly marked “for the attention of Employment Judge McNeill QC”, within 14 days of the date on which this judgment is sent to them, so that judgments for the relevant amounts may be prepared and promulgated as appropriate.
