[1]The claims for unlawful deduction from wages and breach of contract are dismissedREASONS
[1]The Claimant submitted a claim against Phoenix Care (UK) Limited (a company now in voluntary liquidation) in relation to an unlawful deduction from wages of £300.00 (reflecting training costs) and £98.27 (for pension). She also asserts the failure to pay a breach of contract and/or an unlawful deduction from wages in not receiving the National Minimum Wage during periods when the Claimant was on call, sleeping at the Respondent’s care home.[2]The Respondent did not enter a notice of appearance. The matter was listed for hearing before me today together with three other claims against the same Respondent. The Claimant has neither attended nor submitted any written evidence for me to consider, nor has she offered any explanation for her failure to attend or sought to have the proceedings postponed to another day. I therefore assume that she no longer wishes to pursue her claims and I am therefore dismissing the claims on the grounds that they are unsupported by any evidence and that the burden is on the Claimant to prove her claims.
