JUDGMENT
[1]The claim was issued in the Employment Tribunal on 21 April 2021. The Respondent has failed to present a valid response on time. Judgment is given for the Claimant under rule 21, following a hearing fixed for that purpose.[2]The claimant was dismissed in breach of contract in respect of notice and the respondent must pay damages to the claimant of £2,160. The sum due to him was calculated as follows2.1 his most recent payslip, being for November 2020, records his basic monthly pay as £936, which equates to £216 per week;2.2 he was employed for 10 complete years and was entitled to 10 weeks’ notice of termination;2.3 having been dismissed without notice, he is entitled to damages in the amount of 10 weeks @ £216.[3]The claimant was dismissed by reason of redundancy and is entitled to a redundancy payment of £3,240. The sum due to him was calculated as follows:3.1 the Claimant was employed from 1 January 2010 until 31 October 2020, being 10 complete years;3.2 he was above the age of 41 for all of those years;3.3 he was entitled to 10 years x 1.5 weeks x £216.[4]The respondent must pay the claimant £5,400 in total.
