JUDGMENT
[1]The respondent has failed to pay holiday pay to the claimant and must pay him £1,153.85 as holiday pay. This is a gross figure and the judgment will be satisfied if the respondent pays a net amount and accounts to HMRC for any tax or national insurance payments due on the payment. On making such a payment the respondent must set out to the claimant what (if any) deductions for tax and national insurance have been made and why they have been made.[2]The claimant was not dismissed in breach of contract. His claim for notice pay is dismissed.
