REASONS

[1]The claimant presented a claim form on 28 June 2023 claiming unpaid salary from the period December 2022 to June 2023, and unpaid accrued holiday pay. The respondent filed a response on 25 July 2023, only admitting to part of the unpaid salary claim.[2]At a private preliminary case management hearing, at which the respondent was represented by Ms A Raines, Chief of Staff, Employment Judge Graham Case Number: 3306110/2023 clarified the claims and made case management orders, including the listing of this hearing to today’s date.[3]At today’s hearing there was no appearance or attendance on behalf of the respondent. Nether was there any contact or correspondence sent to the Tribunal from the respondent for their non-attendance.[4]The claimant informed the Tribunal that since the preliminary hearing the respondent has not complied with the case management orders; there has been no communication from the respondent; that the claimant’s emails to the respondent have bounced back and her telephone calls have been ignored. Notwithstanding the respondent non-compliance and lack of communication the Tribunal was satisfied the respondent had due notice of this hearing and their lack of engagement appeared to suggest that it had no intention of defending this claim, hence their absence today. Nonetheless the Tribunal considered that it was in the interests of justice and in accordance with the overriding objective to proceed with the hearing.[5]The Tribunal was satisfied with the evidence presented by the claimant and the proof of payslips and holiday information. This information reflected the fact that the claimant had not been paid the sums claimed. Accordingly, judgment was given in the sums claimed.
