JUDGMENT

(1) The First Respondent has failed to comply with a requirement of section 188 of the Trade Union & Labour Relations (Consolidation) Act 1992. The claimants’ claims for a protective award succeed.(2) The Tribunal makes a protective award in respect of the claimants listed in the schedule annexed hereto being employees dismissed as redundant on or after 19 June 2020 that the employer pay remuneration for the protected period which begins on 19 June 2020 and is for a period of 90 days. The Recoupment Regulations apply.(3) In all other respects, all other claims brought by the claimants listed in the attached schedule are struck out on the grounds that they are not being actively pursued.(4) The name of the First Respondent on case numbers 3311519/2020 (Miss D Fountain) and 3306252/2020 (Mr A R Feetham) shall be amended to Bertram Trading Limited. Certificate of Correction: Under the provisions of Rule 69 of the Employment Tribunals’ Rules of Procedure 2013, the Judgment sent to the parties on 4 November 2022, is hereby corrected in that the date referred to at paragraph (2) should be and is 19 June 2020.
