JUDGMENT

Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The respondent has failed to comply with a requirement of section 188 of the Trade Union & Labour Relations (Consolidation) Act 1992. The claim for a protective award succeeds.[2]The Tribunal makes a protective award in respect of the claimants who worked at the respondent’s establishment at Morecroft House, Willie Snaith Road, Newmarket, Suffolk, CB8 7SQ and who were dismissed as redundant on or after 23 May 2023 that the employer pay numeration for the protected period which begins on 23 May 2023 and is for a period of 90 days. REASONS

[1]By a letter dated 5 December 2023 the Tribunal gave the claimants an opportunity to make representations or to request a hearing, as to why the complaint of unfair Dismissal should not be struck out because the claimants had not complied with the Order of the Tribunal dated 21 September 2023 it has not been actively pursued.[2]The claimants have failed to make representations in writing, or have failed to make any sufficient representations, why this should not be done or to request a hearing. The complaint of Unfair Dismissal is therefore struck out.
