The claim is struck out.REASONS
[1]By a letter dated 4 February 2025 the Tribunal gave the Claimant an opportunity to make representations or to request a hearing, as to why the claim should not be struck out because the Claimant had not complied with the Order of the Tribunal dated 1 November 2024; and it has not been actively pursued.[2]The Claimant’s reply of 4 February 2025 does not make sufficient representations why this should not be done or to request a hearing. There was no satisfactory explanation for the failure to comply, or the failure to pursue the claim, the Claimant did not propose any timeframe for future compliance, and the Claimant has continued to fail to take steps in the intervening period to advance his claim.[3]The claim is therefore struck out under Rule 38(c) and Rule 38(d) Employment Tribunal Rules of Procedure 2024.
