JUDGMENT

The claimant’s claim for a redundancy payment and his complaint that the claimant was unfairly dismissed are struck out.

REASONS

[1]The claimant claims a redundancy payment and complains of unfair dismissal.[2]Both claims requires a claimant to have not less than two years service.[3]The claimant was employed by the respondent for less than two years.[4]Therefore the claimant is not entitled to bring such complaints.[5]The claimant has failed to give an acceptable reason, despite being given the opportunity to do so, why the complaints should not be struck out.[6]Accordingly, the claim for a redundancy payment and the complaint of unfair dismissal are struck out. The claimant’s other complaints are not affected by this judgment. Approved by Employment Judge Anstis 14 February 2025[1]By a letter dated 7 July 2025 the Tribunal asked the claimant to provide details of his claim for ‘other payments’.[2]In an email dated 20 July the claimant provided a schedule of loss making reference to a basic award for unfair dismissal, a compensatory award for unfair dismissal and a claim for injury to feelings.[3]The claimant’s claim for unfair dismissal has been struck out.[4]The claimant is not making any claim in respect of which an award of injury to feelings can be made.[5]There is no reasonable prospect of any award being made to the claimant for ‘other payments’ because the claimant has not specified any basis for such an award to be made.[6]The preliminary hearing fixed for 5 November 2025 will not take place.
