JUDGMENT
Employment Tribunals Rules of Procedure 2013 – Rule 21[1]The claims against the First Respondent are dismissed.[2]An unauthorised deduction was made from the Claimant’s wages, by failing to pay the Claimant holiday pay accrued before his dismissal, and the Second Respondent is ordered to pay the Claimant the sum of £ 136.01, being the gross amount deducted ( £346.84) less the amount already paid to the Claimant by the Insolvency Service (£ 210.83).[3]An unauthorised deduction was made from the Claimant’s wages, by failing to pay the Claimant for six days worked before his dismissal, and the Second Respondent is ordered to pay the Claimant the gross sum of £ 623.08.[4]The Claimant was dismissed in breach of contract in respect of notice and the Second Respondent is ordered to pay damages to the Claimant in the sum of Case No: 3305353/2020 £ 1450.58 (being one month’s net pay £ 1824.65 less the £ 374.07 already paid by the insolvency service).
