[1]The claimant’s claim of disability discrimination is dismissed on withdrawal.[2]The claimant’s claim for holiday pay is dismissed on withdrawal.[3]The claimant’s other claims continue, subject to a separate deposit order.REASONS
[1]The claimant withdrew his complaints of disability discrimination and for holiday pay at a preliminary hearing on 5 May 2021. He was ordered to pay a deposit of £100.00 in respect of his remaining complaints of unfair dismissal, for notice pay, arrears of pay and/or other payments. The deposit order was sent to the claimant on 5 May 2021. The claimant has failed to pay this deposit. The claimant’s remaining complaints are therefore struck out under rule 39(4) of the Employment Tribunals Rules of Procedure 2013.[2]The hearing fixed for 4 February 2022 will not take place.
