Mr A Desouza v Dnata Catering UK: 3305144/2024
JUDGMENT
The complaint that the claimant was unfairly dismissed is struck out.REASONS
[1]The claimant complains of unfair dismissal and unpaid wages.[2]The claimant was dismissed on 8 December 2023, and then following an appeal was reinstated on 2 February 2024. The claimant was paid all his back pay for the period between dismissal and reinstatement.[3]The claimant’s complaints of unfair dismissal has no reasonable prospect of success.[4]The claimant has now been paid for the period between his dismissal and reinstatement, he is not making any claim for any other consequential loss. Therefore the tribunal cannot order that the claimant recover any further sums from the respondent.[5]The claimant has failed to give an acceptable reason, despite being given the opportunity to do so, why the complaint should not be struck out.[6]Accordingly, the complaints of unfair dismissal and unpaid wages are struck out.
